In order to receive statutory pay, employees must have:
- Worked at least 30 days in the preceding 12 months (most employers will count approved leaves of absence such as vacation or maternity as “worked” days), and
- Worked the scheduled shift before and after the holiday (unless the employer has approved an absence).
How do I determine if the holiday falls on a “regular day of work”?
- The employee must have worked that day for at least 5 of the previous 9 weeks.
- For example, an employee must have worked at least 5 of the last 9 Mondays to be eligible for holiday pay on a statutory holiday that falls on a Monday.
